You agree to indemnify, defend and hold harmless Sonic Freedom.com for any unforeseen natural, act of God and/or man-made disasters affecting this website, and its Email and website communications.

4. Third Party Rights.

Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

5. Term; Termination.

TERMS OF SERVICE: Site user is bound by the Ministry Terms of Service and acknowledges he or she

ASSUMPTION OF RISK: You are fully aware that receiving/participating in the service may contain risks of injury. You know and fully understand the scope, nature and extent of the risks involved in the service, products, and activities contemplated by this Agreement. You voluntarily and freely choose to incur and assume any and all such risks and dangers. If you choose, you will be giving up certain valuable legal rights to sue Site and/or assignees, their families, trustees, officers, directors, representatives, volunteers, contractors, and/or successors (if any) for any personal, legal, physical, psychological, or emotional injuries you may suffer as a result of the service. WAIVER OF PUNITIVE DAMAGES: You understand and agree that you are waiving and forever abandoning any claims for punitive or exemplary damages against Site and/or assignees. You voluntarily choose to give up this Right. Site user agrees to understand that You are personally responsible for all your actions, mental, physical, emotional, and including actions that are of a "legal or lawful nature" that you may undertake, and they are freely taken as your own, regardless of the education given and/or outcome.

NO CONFLICT (of Interest): Site user promises to NOT have any agreement, relationship, conflict of interest or commitment to any other person or entity that conflicts with the Site user's obligations to the Ministry or the Ministry's obligations to the Site user under this Agreement and Contract.

DISPUTE RESOLUTION: The Ministry and Site user commit to first seek dispute resolution through individual discussions with the ministry founder or natural person involved in the dispute, and then if necessary, through more Prayer. Should outside dispute resolution between the Ministry and the Site user become necessary, the Ministry and the Site user agree to both commit to seek a biblical Matthew 18.15-17 private dispute resolution.

CONFLICT RESOLUTION BY MEDIATION Via Holy Bible Matthew 18.15-17: (See paragraph 2 above plus as follows). You agree that a corporation STATE court is incapable of impartial judicial judgment (more on that; any administrative court processing chattel, is incapable of impartial judicial judgment of and for people [which BY LAW are not fictitious corporate entities or OUGHT NOT BE corporate chattel property]). This shall apply to all claims including allegations that there have been wrongful acts or omissions by Tim Mainka (private unincorporated man), Sonic Freedom s.s.m., and or assignees either intentionally or otherwise. By agreeing to these Terms of Services, you are agreeing that any issue or claim arising out of your participation with Sonic Freedom s.s.m. shall be decided by neutral private mediation according to Son of God's instruction in Matthew 18:15-17 and according to 1Co:6:4 [i.e., If then you have judgments of things pertaining to this life, set them to judge who are least esteemed in the church]; You are waiving your Right to a trial by a Jury or Judge. After mediation, if considered by either party that matters are not fully settled in mediation, as if bona fide cause to justify another impartial mediation, then if bona fide cause is evinced, and all parties agree, a new impartial mediation by humble people of Christ is further agreed to resolve any and all potential unresolved matters. If you are unamicable to Christ's instruction on resolving conflict, then you agree Sonic Freedom s.s.m. may seperate fully, in peace, without prejudice, without recourse, without any obligations to unamicable party (especially if hostile and against Christ/God). Third Mediation Resolution process for same issue(s) will be allowed only for bona fide cause because of proof upon its face fraud evinced.

NECESSARY ACTS, FURTHER ASSURANCES: The parties shall, at their own cost and expense, execute and deliver such further documents and instruments and shall take such other actions as may be reasonably required or appropriate to evidence or carry out the intent and purposes of this Agreement and Contract.

ENFORCEABILITY: This Agreement and Contract shall be binding upon, and enforceable by and against, the parties and their respective successors, assigns, and legal representatives in accordance with its terms.

ASSIGNMENT: This Agreement and Contract may not be assigned by either party without the written consent of the other; provided, however, that the Ministry may assign its rights and delegate its duties under this Agreement and Contract without the Site user's consent to a successor by sale, merger, restructuring, reorganization, or liquidation, if such successor carries on the Ministry's Ministry substantially in the form in which it is being conducted at the time of the sale, merger, restructuring, reorganization, or liquidation.

MODIFICATION OF AGREEMENT AND CONTRACT: This Agreement and Contract may be supplemented, amended, or modified by SF at any time so Site user agrees to periodically review. No provisions in either party's correspondence or other Ministry forms used by either party shall supersede or add to the terms and conditions of this Agreement and Contract.

HEADINGS: The heading titles in this Agreement and Contract are included for convenience only and shall neither affect the construction or interpretation of any provision in this Agreement and Contract nor affect any of the rights or obligations of the parties to this Agreement and Contract.

SEVERABILITY: lf a court or an arbitrator of competent jurisdiction holds any provision of this Agreement and Contract to be illegal, unenforceable, or invalid in whole or in part for any reason, the validity and enforceability of the remaining provisions, or portions of them, will not be affected.

PROTECTION OF LAW:
The authority of The Ministry and Site user to enter this agreement and contract and to execute the duties under the terms conditions and obligations of this agreement and contract is protected under the provisions of 1:10, l:4:2: 612:7; 4,5, 6,7 ,9,10. & 14: of the U. S. Constitution, the Supreme Law of the Land, wherein "no state shall pass any laws impairing the obligation of contracts". The Ministry, Site user and the terms, conditions and obligations of this Agreement and Contract are not subject to Federal or State Legislative or Regulatory Control. See Hale v. AGREEMENT RATIFICATION:
GOVERNING LAW: Sonic Freedom s.s.m. is Non-Domestic without United States corp. [Title 28 Section 3002] in the private realm of men and women under God's Golden Rule and Christ's Law of Liberty -- Matthew:7:12: Therefore all things whatsoever you would that men should do to you, do you even so to them: for this is the law...Luke:6:31: And as ye would that men should do to you, do ye also to them likewise...James:1:25: But whoso looks into the perfect law of liberty, and continues therein, he being not a forgetful hearer, but a doer of the work, this man shall be blessed in his deed....James:2:12: So speak you, and so do, as they that shall be judged by the law of liberty. You understand that this Agreement shall be construed and governed by the Son of God's spiritual law of liberty and such jurisdictional distinction. Natural law, Freedom of religion, speech, press, and protections secured and guaranteed by the de jure organic state and federal constitutions are retained and reserved, while exercising private religious jurisdiction outside of for profit CORPORATION STATE jurisdiction. Ministry and its creator retain and reserve all absolute inherent unalienable rights, common law rights, and or rights pursuant to the laws of the de jure Wisconsin state Republic assembly, without the United States corporation [Title 28 Section 3002] and without STATE OF WISCONSIN [Federal Government/corporation(s)], and that this Agreement cannot be modified unless in writing and signed by both parties.

At the discretion of the Ministry, for Applicable Law, This Agreement and Contract and any dispute arising from the relationship between the parties to this Agreement and Contract, may be governed by, construed under, and enforced in accordance with the laws of Wisconsin state and/or the STATE OF WISCONSIN, at the discretion of the Ministry to consent to such. At the discretion of the Ministry, for Applicable Jurisdiction, Jurisdiction for any dispute arising from the relationship between parties to this Agreement and Contract may be common law on the Republic for Wisconsin and/or the STATE OF WISCONSIN at the discretion of the Ministry to consent to non ecclesiatical jurisdiction, outside of the private ministry's jurisdiction.

ENTIRE AGREEMENT: You understand that this Agreement contains all the promises and agreements between the parties with regard to the release of Tim Mainka (private unincorporated man) and or SonicFreedom.com and/or assigns and you acknowledge there are no oral or written promises or agreements outside of this Agreement regarding the release of Tim Mainka (private unincorporated man), Sonic Freedom s.s.m. and or assignees. This Agreement constitutes the final, complete, and exclusive statement of the terms of the agreement between the parties and supersedes all prior and contemporaneous understandings or agreements of the parties. No party has been induced to enter into this Agreement and Contract by, nor is any party relying on, any representation or warranty outside those expressly set forth in this Agreement and Contract.

BINDING: You hereby expressly recognize that this Agreement is binding. You have released any and all claims against the indemnified parties resulting from your participation in Sonic Freedom s.s.m., service, the educational assistance, products, Site, including any claims caused by negligence of indemnified parties.

YOU HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. YOU CERTIFY THAT YOU ARE 18 YEARS OF AGE OR OLDER, AND ACCEPT THIS AGREEMENT OF YOUR OWN FREE WILL. ALL GIFTS RECEIVED FOR SERVICES OR OTHER PRODUCTS ARE NON-REFUNDABLE. YOU RESERVE ALL YOUR RIGHTS NOT GIVEN UP AND AGREED UPON IN THIS TOS/AGREEMENT.
